New York Deeds

A deed is a legal document used to grant a right. A deed can be considered a type of contract since they require the mutual agreement of two people and are most commonly used to transfer the title of real estate from one person to another. A deed needs to meet six requirements for it to be recognized by common law. Those six requirements are that it must indicate that it conveys a privilege of some sort to another person by using the word ‘hereby,’ the grantor must have the legal ability to grant the object to the other person, the person receiving the object must have the legal capacity to accept it, a seal must be affixed to the document and it must be delivered to and accepted by the recipient of the deed. There are four main type of deeds and they are general and special warranty, bargain and sale deed, quitclaim deed and a deed of trust. A deed can be joint ownership if a person so chooses. The only way a deed can be joint ownership is if the grantor names a successor to the dead upon the grantor’s death.

A deed will contain the names of the old and the new owners of the property, a legal description of the property, and is signed by the person who is transferring the property. Real estate can almost never be transferred legally without having something in writing. When drafting and legalizing a deed it must always be notarized, filed in the public records, and also have to be witnessed in most cases. Since deeds are filed in the public records, anyone can head to their local library or courthouse (whichever houses the public records) and obtain deeds that have been put into action. A deed can transfer real estate to the following:

  • Spouse
  • Siblings
  • Children
  • Parents
  • Cousins
  • Aunts or uncles
  • Friends
  • Coworkers
  • Acquaintances
  • Anyone buying the piece of property

An attorney will be able to answer any and all questions regarding the drafting of a deed and should be present before a grantor or a beneficiary signs a deed to transfer or acquire a piece of real estate. An attorney with experience dealing with deeds will be able to word the document properly when drafting the deed.
